Parties to the Agreement
This Collective Bargaining Agreement (hereinafter referred to as "Agreement") is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
{{company_name}}, a company duly incorporated under the laws of {{country}}, with its principal place of business at {{company_address}} (hereinafter referred to as "the Employer"), and
{{union_name}}, a duly registered trade union representing employees of the Employer, with its registered office at {{union_address}} (hereinafter referred to as "the Union").
Preamble and Purpose
WHEREAS, the Employer and the Union desire to establish and maintain harmonious industrial relations, promoting productivity, efficiency, and the welfare of employees;
WHEREAS, this Agreement aims to set forth the terms and conditions of employment, benefits, and mutual responsibilities in a clear and comprehensive manner;
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:
Recognition and Scope
The Employer recognises the Union as the sole and exclusive bargaining agent for all employees within the bargaining unit, as defined in {{relevant_labour_legislation}}.
The bargaining unit shall comprise all permanent employees of the Employer, excluding managerial, supervisory, confidential, and temporary staff, as more fully described in Appendix A.
Terms and Conditions of Employment
**5.1 Wages and Salaries:** The Employer agrees to pay wages and salaries according to the attached wage schedule (Appendix B), which shall be reviewed annually on or before {{review_date}}.
**5.2 Working Hours:** The standard working week shall consist of {{standard_hours}} hours, spread over {{number_of_days}} days. Overtime shall be compensated at the rate of {{overtime_rate}} times the ordinary hourly rate.
**5.3 Leave Entitlements:** Employees shall be entitled to annual leave of {{annual_leave_days}} days, sick leave of {{sick_leave_days}} days, and family responsibility leave as per statutory requirements. Specific provisions for maternity and paternity leave are outlined in Appendix C.
**5.4 Public Holidays:** Employees shall be entitled to all gazetted public holidays with full pay. Work performed on a public holiday shall be compensated at {{public_holiday_rate}} times the ordinary hourly rate.
Benefits and Welfare
**6.1 Medical Aid:** The Employer shall contribute {{employer_medical_contribution_percentage}}% towards an approved medical aid scheme for employees, with the employee contributing the remaining {{employee_medical_contribution_percentage}}%.
**6.2 Provident Fund/Pension Scheme:** The Employer shall contribute {{employer_provident_contribution_percentage}}% of the employee’s basic salary to an approved provident or pension fund, with the employee contributing {{employee_provident_contribution_percentage}}%.
**6.3 Training and Development:** The Employer commits to providing opportunities for employee training and development, as outlined in the annual training plan developed in consultation with the Union.
Dispute Resolution Procedure
Any disputes arising from the interpretation or application of this Agreement shall be resolved through the following steps:
**7.1 Stage 1 - Internal Discussion:** The employee and their shop steward or Union representative will first attempt to resolve the dispute with their immediate supervisor.
**7.2 Stage 2 - Formal Grievance:** If unresolved, a formal written grievance shall be submitted to the Human Resources Department within {{grievance_submission_days}} working days.
**7.3 Stage 3 - Mediation/Conciliation:** If the grievance remains unresolved, the parties shall refer the matter to mediation or conciliation by an independent mediator/conciliator within {{mediation_referral_days}} working days.
**7.4 Stage 4 - Arbitration:** If mediation/conciliation fails, either party may refer the dispute to binding arbitration in accordance with the rules of {{arbitration_body}}.
Discipline and Dismissal
Disciplinary action and dismissal procedures shall be conducted in accordance with the Employer’s disciplinary code and procedure, which shall be fair, consistent, and comply with all applicable labour laws. The Union shall be notified of any serious disciplinary action or dismissal involving its members.
Duration and Termination
This Agreement shall become effective on {{effective_date}} and shall remain in full force and effect for a period of {{agreement_duration_years}} years, until {{expiry_date}}.
Either party may give written notice of its intention to renegotiate the Agreement not less than {{notice_period_months}} months prior to its expiration date.
General Provisions
**10.1 Severability:** If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
**10.2 Entire Agreement:** This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and negotiations, whether written or oral.
**10.3 Governing Law:** This Agreement shall be governed by and construed in accordance with the labour laws of {{country}}.
